Preamble

The site www.hotel-madison.com, hereinafter referred to as “the site” is a hotel reservation tool.

It is published by Biografy Group, with a capital of 27 011 535€, whose head office is located at 32, avenue de l'Opéra — 75002 PARIS and registered in the Paris Trade and Companies Register under the number RCS 429 706 781. For the application of these general conditions of sale, it is agreed that the customers and HOTEL MADISON will be collectively referred to as the “Parties” and individually referred to as the “Party” and that the user who has validated a reservation or an order will then be referred to as the “customer”.

These general conditions of sale apply to all countries and all currencies. Any reservation or order implies total adherence to the general conditions of sale.

HOTEL MADISON reserves the right to modify these general conditions of sale at any time by publishing a new version on the Site. The applicable general conditions of sale remain those that came into force on the date of the reservation or the placing of the order.

ARTICLE 1: LEXICON

“Confirmation email”: Email sent by HOTEL MADISON, at the last stage of the reservation or order process. This summarizes the reservation validated by the customer and confirms its receipt by the site www.hotel-madison.com. The confirmation email constitutes a reservation confirmation as defined below.

“Booking confirmation”: A dematerialized document that summarizes the characteristics of the services booked at the end of the reservation process and its validation by the Customer. The reservation confirmation takes place in particular after a reservation made on the site. www.hotel-madison.com, during which your bank card number is entered as part of an online payment or a guarantee before proceeding with its final validation.

“Establishment Contract”: Contract whose purpose is the provision by HOTEL MADISON establishments of all the services defined below and which were actually ordered by the Customer at the end of the validation of his online reservation or by another method of reservation.

“Customer”: An adult natural person with full legal capacity at the time of subscription of the establishment's contract.

“Reservation request”: Request for the reservation of rooms or tables in the restaurant, made by the customer through mobile communication services or by internet.

“Mobile Services”: All services and protocols for connecting mobile phones to the Internet, and in particular allowing the consultation and reservation of services provided by HOTEL MADISON.

“Online reservation”: Reservation of rooms, restaurant tables and any accessories or additional services offered by the HOTEL MADISON establishment on its site www.hotel-madison.com.

“Reservation by telephone or email”: Reservation of rooms or additional services offered by HOTEL MADISON by telephone or by sending an email by the Customer, responding to the reservation registration process as described in these general conditions of sale.

“establishment”: Refers to the HOTEL MADISON establishment including rooms or any other ancillary services offered on the site www.hotel-madison.com.

“Services”: Services marketed by HOTEL MADISON consisting, under a contract with the establishment, in the provision of rooms whose essential characteristics are presented on the site www.hotel-madison.com with or without meal and/or breakfast services and other complementary services related to temporary accommodation, and in particular artistic activities. These services, in accordance with the provisions of article L. 111-1 of the Consumer Code, appear on the website. www.hotel-madison.com.

“Extras”: Services marketed by HOTEL MADISON consisting, under a contract between the establishment and the customers, in services that are different and complementary to those offered in the provision of rooms whose essential characteristics are presented on the website www.hotel-madison.com.

“Website”: electronic service operated by HOTEL MADISON on the Internet and accessible via the following URL: www.hotel-madison.com.

“WAP”: communication protocol whose purpose is to allow access to the Internet using a mobile terminal.

ARTICLE 2: SCOPE OF APPLICATION

2.1 EXTENDED

These general conditions apply, without restriction or reservation, to all the services offered on the website. www.hotel-madison.com by HOTEL MADISON operating the above site in particular for the purpose of booking rooms and other services complementary to temporary accommodation in the establishment.

2.1.2. These General Terms and Conditions apply to all subscription transactions for the services defined above carried out by the Customer.

2.2 TERRITORY

The services appearing on this website are offered to be provided to the Customer by HOTEL MADISON in one of its establishments to the exclusion of any other location following an effective reservation by the Customer.

2.3 DURATION

2.3.1. These general conditions apply for as long as the services are put online by HOTEL MADISON on its site. www.hotel-madison.com

2.3.2. HOTEL MADISON reserves the right, without notice or compensation, to temporarily or permanently close the website www.hotel-madison.com or the online reservation area.

2.3.3. HOTEL MADISON is not responsible for damages of any kind that may result from temporary unavailability or the permanent closure of all or part of the site or the services associated with it, such as the online reservation area.

2.4 LEGAL REGIME

2.4.1. These general conditions are subject to the provisions of articles L. 121-16 and following of the Consumer Code.

2.4.2. Any reservation for the consumption of the services defined above, made on the website www.hotel-madison.com is subject to these general and specific conditions of rates for each of the said HOTEL MADISON services listed below.

2.5. OBJECT

2.5.1. These general conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by HOTEL MADISON on its website. www.hotel-madison.com

2.5.2. They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties, for its maintenance and for its validity.

ARTICLE 3: CUSTOMER CAPACITY AND ACCEPTANCE

3.1 The customer does not have any legal right of withdrawal when buying a stay online. Indeed, Article L. 221—21- 8 12° of the Consumer Code indeed provides that the right of withdrawal cannot be exercised, among other things, for contracts for the provision of accommodation services.

3.2. Every Customer acknowledges having the capacity to contract under the conditions described in the general conditions presented below, i.e. having the legal majority and not being under guardianship or guardianship. However, the Management of the establishment reserves the right to request from the Customer, upon arrival at the establishment, a document supporting his identity including, in particular, an indication of his date of birth.

3.3. The Customer acknowledges that these conditions are an integral part of the establishment's contract.

3.4. The Customer accepts that the General Conditions, the contractual documents informing him of the particular services and prices of each of the services, as well as the order forms and the procedures for doing so, are presented to him online on the site. www.hotel-madison.com for the purposes of concluding the Establishment Contract.

3.5. The Customer declares to have obtained from HOTEL MADISON all the necessary information on the site. www.hotel-madison.com

3.6. The Customer acknowledges having read these general conditions, having accepted them, as well as all the terms of the proposal before having placed his order and having accepted all of the terms.

3.7. Any validation of online reservations from the website www.hotel-madison.com through the Customer assumes the consultation and prior acceptance of these general conditions.

3.8. The Customer's agreement concerning these general conditions occurs during the reservation process, prior to the validation of his reservation.

3.9. The Customer, prior to ordering the services, declares that the reservation of these services is made for his personal needs.

3.10. The Customer has the option of saving and editing these general conditions from the site. www.hotel-madison.com using the standard functionalities of your browser and/or computer, in particular under the “Terms and Conditions” tab.

3.11. The Customer expressly accepts that the entry of the required banking information, the acceptance of these general conditions and the validation of the voucher or the reservation request, constitute an electronic signature within the meaning of article 1316-4 of the Civil Code which has, between the parties, the same value as a handwritten signature.

3.12. The Customer, following presentation of his identity document as stated in article 3.1 above, undertakes to fill out the individual police form in the countries concerned by this article, in accordance with the provisions of article R. 611-42 of the Code of Entry and Residence of Foreigners.

ARTICLE 4: CONTENT OF THE SITE

4.1. The site mentions the following information:

The identification of the company HOTEL MADISON indicating its corporate name, the address where it is established, its email address.
The essential characteristics of the accommodations offered (the sheets for each category of rooms offered) can be consulted without reservation under the “ROOMS” section for each of the establishments concerned, during the reservation process under the room availability calendar and when choosing the room according to the dates chosen by the Customer for his reservation, which may be illustrated with a photographic image of a room at the same rate. However, it is specified that THE PHOTOS ARE NOT CONTRACTUAL insofar as the elements of interior presentation or decoration as well as the sizes of the rooms are different within the same establishment (or from one establishment to another).
The prices of each of the services relating to accommodation and additional services.
The terms of payment.
The general conditions of sale.
The validity period of the offer and the price of the offer.
The minimum duration of the proposed contract, if applicable.
The absence of the right of withdrawal and, where applicable, the cancellation procedures.

4.2. All the information on the website www.hotel-madison.com is presented in French and English.

ARTICLE 5: RESERVATION

5.1. ONLINE BOOKING METHODS

5.1.1. The Customer chooses the services presented on the site www.hotel-madison.com, which offers him the possibility of reserving a room or a table, according to transparent contractual rates with or without options or Extras left to the Customer's free subscription.

5.1.2. The Customer acknowledges having read the nature, the destination and the methods of booking the services available on the website. www.hotel-madison.com and have requested and obtained the necessary and/or additional information to make a reservation in full knowledge of the facts.

5.1.3. The Customer is solely responsible for the choice of services and their suitability to their needs, so that the responsibility of HOTEL MADISON cannot be sought in this regard.

5.1.4. The reservation is deemed accepted by the customer at the end of the reservation process by clicking on the “CONFIRM RESERVATION” field.

5.2. ONLINE BOOKING PROCESS

5.2.1. The reservation is confirmed upon receipt by the customer of the reservation confirmation sent by HOTEL MADISON, or during online payment by bank card under the conditions referred to in article 5.2.4. A confirmation screen will then appear online.

5.2.2. The Customer undertakes, prior to any reservation, to complete the information requested.

5.2.3. The customer attests to the veracity and accuracy of the information provided.

5.2.4. The reservation procedure includes, in particular, the following steps, it being specified that it is always possible for the Customer to reverse the reservation process:

Choice of place to stay: the Customer determines by a click the establishment by choosing the city of the stay.
Choice of the start date of the stay (arrival) and the end date of the stay (departure)
If the arrival and departure dates are not entered, a calendar showing the available or full days for the previously selected establishment is displayed. For each available day, the calendar shows the best available rate under the date. This shows the best available rate per night and for one customer. By clicking on the dates, the Customer can select their arrival and departure day and thus access the next steps.
Choice of the number of rooms reserved: The Customer determines by a click the number of rooms chosen on the dates of his stay. In case of booking several rooms the reservation process continues room by room.
Choice of the number of adults for the room: The Customer determines by one click the number of adults per room.
Choice of the number of children for the room: The Customer determines by one click the number of children per room.
Choice of rooms and associated rates: The Customer determines by a click between the various rooms and available rates offered according to the information entered during the previous steps, including their essential characteristics, such as the category of the room on the date previously chosen, its price, its level of equipment, any Extras included for special offers, cancellation conditions, payment conditions. It is recalled here that the photos or perspectives integrated into the site are not contractual.
Choice of Extras: the customer can add by a simple click and depending on their availability, one or more extras offered according to the information entered during the previous steps. These extras have specific prices, quantities, and characteristics. By clicking on “add” or “add an element”, the Customer completes the selection and entry of the elements that are the subject of the online reservation, without prejudice, however, to being able to modify the elements of his reservation by going back to the reservation process previously carried out.

Finalization of the reservation: by clicking on the “confirm my reservation” button, the customer validates the summarized and displayed elements composing his reservation and reveals the fields necessary for the Customer to enter information on his identity, his contact details, including the postal address, the e-mail and the telephone number, including the postal address, the e-mail and the telephone number, and the type of stay, as well as the method of payment and the details of the bank card used for online payment, for taking guarantees by bank card details according to the rate chosen; at acceptance of these general conditions; upon final validation by the Customer of his reservation by clicking under the “Confirm reservation” field at the bottom of the page. Before confirming his reservation, the Customer may write in a field dedicated to this purpose “special requests”, a request for clarification or a special request, which is not contractually guaranteed by HOTEL MADISON unless a written response is received from the registration of the request with the possibility of providing the requested service including the indication of its price, if necessary, for the purposes of acceptance by the Customer. By clicking on “Confirm reservation” the customer pays, or gives his guarantee by credit card according to the rate he has booked. Last step: registration by HOTEL MADISON of the reservation made by the Customer and allocation of a related reservation confirmation number.

5.3. ONLINE CONTRACT FORMATION

5.3.1. In accordance with articles 3.10 and 5.2.4, the establishment Contract is formed at the time of confirmation of the Customer's reservation by HOTEL MADISON including the assignment of the relevant reference number as stated in the previous article.

5.3.2. The establishment contract can only be formed after the Customer has previously chosen the content of his reservation, which was completely summarized to him at the last stage of the reservation process, has accepted these general conditions and finally has validated his reservation by clicking on the “Confirm reservation” button. Otherwise the reservation is considered interrupted and cannot produce any effect.

5.3.3. In all cases of online reservations, a summary email is sent to the Customer at the email address he indicated in the field reserved for this purpose. This email constitutes an acknowledgement of receipt of the reservation and the confirmation of the reservation which summarizes the terms of the contract, the services reserved, the prices, the price conditions relating to the selected rate, the information relating to after-sales service and commercial guarantees if they exist, the methods of exercising the possible right of withdrawal or cancellation, as well as the address of HOTEL MADISON to which the customer can present complaints.

5.4. OTHER BOOKING METHODS (EXCEPT “ONLINE”)

5.4.1. Booking by phone

5.4.1.1. Telephone reservations as defined below are made at the telephone numbers listed below.

5.4.1.2. At the time of the reservation request made by telephone by the Customer, HOTEL MADISON offers the available rates and related additional services according to the Customer's request on the dates he requests. HOTEL MADISON also requests a telephone number and an e-mail address where HOTEL MADISON will send him, these general conditions of sale as well as the summary of his reservation request, and, where applicable, the request for the indication of bank details for the purposes of registering his reservation, with or without payment during the process of reserving the price, a deposit or a guarantee by bank card details in accordance with the applicable rate by the Customer when requesting reservation.

5.4.1.3. All the information and conditions required by HOTEL MADISON in response to the Customer's reservation request by telephone constitute substantial formalities for registering the Customer's reservation made by telephone. Otherwise the reservation cannot be validated or confirmed.

5.4.1.4. By sending back at least the information required by HOTEL MADISON by e-mail, the Customer may not complain about the lack of registration of his reservation, the establishment's contract not being formed due to his failure to provide this information and conditions. Only the written confirmation of the registration of the reservation will constitute the conclusion of the contract.

5.4.3. Booking by email

5.4.3.1. E-mail reservations as defined below are made to the email address indicated on the pages of the site, either resa@hotel-madison.com

5.4.3.2. When a reservation request is made by email, HOTEL MADISON offers, by returning an email to the address from which the reservation request is made, the available rates and related additional services, according to the Customer's request on the dates requested by the Customer. HOTEL MADISON sends him by the same return e-mail the present general conditions of sale at his request as well as the summary of his reservation request, and, where applicable, the request for the indication of bank details for the purposes of registering his reservation, with or without payment during the process of reserving the price, of a deposit or of the security deposit of a guarantee by bank card details according to the applicable rate determined by the Customer during his reservation request.

5.4.3.3. All the information and conditions required by HOTEL MADISON in response to the Customer's reservation request by e-mail constitute substantial formalities for registering the Customer's reservation made by e-mail. If the Customer, having made a reservation request by e-mail, does not comply with the requirements expected by these general conditions of sale of HOTEL MADISON, the Customer will not be able to complain about the lack of registration of his reservation. Only the written confirmation of the reservation registration is valid for granted.

5.5 Right of Withdrawal/Cancellation by the Customer:

5.5.1. For Accommodation services (reservation of rooms in an establishment or other types of accommodation), the Customer is reminded that he does not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code, in accordance with Article L. 221-28 paragraph 12 of the Consumer Code, which excludes this right for contracts relating to the provision of accommodation services that must be provided at a specific date or period.

5.5.2. Without prejudice to the provisions referred to in article 5.5.1, the contractual conditions may, where appropriate, provide, depending on the content of the reservation validated by the Customer, and as indicated for each rate, a right of cancellation when the reservation is made under the heading “Flexible rates/Flexible rate”. In this case, the Customer was able to read the related cancellation conditions. Conditions are also recalled during the various stages leading to payment.

5.5.3. If the special conditions of the rate allow it, either for bookings made only under the heading “Flexible rates/Flexible rate” or under another wording expressly mentioning the benefit of this right of cancellation, the right of cancellation by the Customer must be exercised before 15:00 p.m., two days before arrival - Paris time (France). Late notification of cancellation involves the application of late cancellation fees amounting to an amount equal to the first night's accommodation, plus any extras included in the Customer's reservation, according to the applicable rate, all taxes included in the reservation validated by the Customer.

5.5.4. The right of cancellation defined in article 5.5.2, is likely to be implemented by the Customer on the website www.hotel-madison.com, under the my account page, after logging in with your confirmation number or by email and password. The option tab then suggests cancelling the reservation. By clicking on the OK button, the cancellation will take effect immediately and all packages associated with this reservation will also be cancelled. A cancellation confirmation email will then be sent to the customer.

5.5.4.1 Depending on the offers selected by the Customer, cancellation by telephone is also possible. This must be accompanied by an email from the Customer and will follow by an email confirming the cancellation from HOTEL MADISON.

5.5.5. In the event of interruption of the stay, the entire agreed price will be collected without the right to reimbursement or to any credit note or exchange for the Customer for the unused part of the stay in the establishment. In the case of a reservation with payment during the reservation process, no refund will be granted as a result.

5.5.6. Unless otherwise expressly provided, in particular in the event of the subscription of extras for this purpose, the customer must vacate their room before 12:00 on the day of the end of their stay. Late check-out may be offered subject to hotel availability. Additional charges may apply depending on departure time. We invite you to contact the reception to check availability and to find out the applicable conditions. If the room is not vacated after the deadline, fees equivalent to one additional night may be charged, depending on the category of the room occupied and the rate in force for the date concerned. In case of non-availability of a room, HOTEL MADISON reserves the right to access the unvacated room in order to prepare the room for new arrivals.

5.5.7. Without prejudice to the application of the right to cancel under the conditions of article 5.5 for the “Flexible Rates/Flexible Rate”, any non-presentation by the Customer at the establishment or no show (reservation not cancelled in the event of a right of cancellation and customer not present) without prior information from the establishment to take possession of the room he has booked, constitutes release of his reservation in its entirety, implying the reavailability of the booked night (s) and automatically leads to The exigibility of the first night of costs relating to the booked stay, including all the extras reserved, all taxes included without any right to reimbursement for the benefit of the Customer.

5.5.8. The conditions mentioned in articles 6 prevail over all booking methods: internet, email, telephone or social networks.

ARTICLE 6: RATES & PRICES

6.1. The prices relating to the reservation of services are indicated before and during the reservation process. The prices are valid in real time and are displayed under the conditions provided for in article 5.2.4. Likewise, for other methods of booking by telephone or e-mail, the rates are valid at the time of the reservation request made by the Customer. They are also available under the heading “Overview of the rates available on the calendar”. In any event, the special pricing conditions linked to each rate/type of room, or additional services, appear in front of each of the services subject to the reservation by the Customer.

6.2. The prices indicated are per room and per adult, it being specified that the chosen rate implies by default and unless a specific “extra” has been taken out, for this purpose, that the Customer takes the room (check-in) at 15:00 and that the Customer checks out at 12:00pm. During check-in, a credit card imprint and an identity document will be required. During the check-out upon no-show of the customer, HOTEL MADISON reserves the right to debit the credit card imprinted during check in.

6.3. Prices are subject to value added tax (VAT) and are displayed in an amount including VAT at the rate in force at the time of confirmation of the reservation, in Euros or in the currency selected by the customer. The prices shown are only valid for the period indicated on the website.

6.4. If the payment is made in a currency other than the currency of the customer's country of residence, the exchange costs will be borne by the customer.

6.5. All reservations are payable in Euros as specified during the reservation process.

6.6. Unless otherwise specified, additional services and other extras that may be selected are not included in the price. However, the price of these additional services validated in the Customer's reservation is due during the online or offline reservation process as long as it is a different rate from the “Flexible rates/Flexible rate”. These rates are also subject to VAT at the rate in force at the time of reservation, where applicable, depending on the regulations applicable for these categories of products or services under a rate other than that applicable to the reservation of rooms.

6.7. Tourist tax: the amount of tourist tax is provided per day and per person, for information purposes only, and is subject to change. This tax collected for the benefit of the municipalities of Paris will be payable, on site, during the stay.

6.8. The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will automatically be reflected in the prices indicated, in particular in the event of a change in the rate applicable on the day of consumption of the stay and the Extras purchased compared to the rates applicable at the time the reservation was made.

6.9. If a rate implies that payment is made at the establishment at the time of arrival or departure of your stay, and if the customer's currency is not the same as that of the country in which the establishment is located, the rate charged by the establishment is likely to be different from that which was communicated when booking, taking into account the possible evolution of exchange rates between the date of reservation and the dates of stay at the establishment.

6.10. Any object stolen from the room during the stay will be invoiced at the current rate. Rates available at the reception of each establishment.

6.11. In the event of deterioration of the room, common areas or various objects, HOTEL MADISON reserves the right to charge the customer at the rate of damage caused.

ARTICLE 7: PAYMENT

7.1. The Customer provides his bank details as a guarantee of the reservation except for special conditions or rates requiring online payment as stipulated during the reservation process and, in particular, those offered under the headings “internet, best available rate”.

The entry of payment methods is secured by SSL encryption. The following information will be requested in order to finalize your reservations: card number, validity date and visual cryptogram as part of an online payment via the payment platform dedicated to this purpose. The same applies to the communication of the bank details required in the context of reservations made by telephone or e-mail according to the required form conditions which involve either payment at the time of booking, or the requirement of a security deposit by bank card imprint according to the price of the reservation.

7.2. The debit of the payment is made at the establishment during the stay, except in the case of special conditions or rates where the debit of the payment is made during the reservation when it comes to certain rates subject to the requirement of payment during the reservation process according to the relevant special contractual conditions previously accepted by the Customer.

7.3. The service provider chosen by HOTEL MADISON to secure online payments by bank card, verifies the validity of the customer's payment card. There may be a refusal of the payment card for several reasons: stolen card, card blocked, limit reached, input error... In case of difficulty or impediment, the customer must contact his bank on the one hand to identify his origin, on the one hand, to his bank to identify his origin, and on the other hand, to the establishment to confirm his reservation and his method of payment.

7.4. If the customer books several rooms but payment, online and in any case during the reservation process, is only necessary for one room, for example, in this case, the payment card that is used on the payment platform allows, on the one hand, to pay for the room concerned by the online payment and, in any case during the reservation process, on the other hand to serve as a guarantee for the other rooms.

7.5. At the time of online payment and in any case when required during the reservation process, the amount that is debited when booking includes: the price of the accommodation, the taxes related to the accommodation, the price of additional services or “extras”.

7.6. In the case of a rate subject to online payment, the debit is made at the time of the completion of the reservation by the Customer following an online debit computer process.

7.7. Following the stay at the HOTEL MADISON establishment and regardless of how the reservation took place, an invoice is drawn up in duplicate by HOTEL MADISON, a copy of which is given or sent by email to the Customer upon departure from the establishment.

7.8. During the Customer's stay, when payment, online and in any case during the reservation process, has not already taken place, and if the amount of the Customer's invoice exceeds the value of 400 Euros, the Management may require payment of the service provided, in respect of said stay, in the forms provided for in this article 7.

7.9. Payment by check is not accepted, whether it is a temporary accommodation service, and/or a catering service and/or any other services or sales of products delivered by HOTEL MADISON to the Customer during his visit to the establishment.

7.10 In any event, any “Extras” or other service that has been booked and delivered by HOTEL MADISON during the Customer's stay and that has not been the subject of prior payment at the time of booking must be paid by the Customer at the latest during Check-Out.

8.1. HOTEL MADISON is required to guarantee the conformity of the services, under the conditions set out in articles L. 111-2. of the Consumer Code, without prejudice to any additional contractual guarantee that may be agreed upon in particular between the parties, outside of these general conditions, in accordance with a written contract duly signed by the parties.

8.2. HOTEL MADISON strives to ensure that the photographs, graphics and texts provided give as accurate an overview as possible of the accommodation, catering and other complementary services offered. However, the Photographs are not contractual, because, on the one hand, the various rooms, even when they fall under the same rate, all have different dimensions, and, on the other hand, variations may occur, in particular, due to the change of furniture, new decoration or possible renovations. Subject to availability, with the exception of a reservation made with an express request for the allocation of a particular room and which would be confirmed in writing, in this sense, by HOTEL MADISON, the Customer cannot claim any claim as a result, as long as these variations do not relate to the essential characteristics of the service.

8.3.
